BIG CITY KIDS, LLC
ANNUAL RELEASE, WAIVER OF LIABILITY, ASSUMPTION OF
RISK, AND INDEMNIFICATION AGREEMENT
PLEASE READ CAREFULLY. THIS IS A LEGAL DOCUMENT THAT AFFECTS YOUR LEGAL RIGHTS.
In consideration of being permitted to enter and use the facilities and participate in activities provided by Big City
Kids, LLC, a Florida limited liability company (“Big City Kids” or the “Company”), located at 12601 Trade Way Drive,
Bonita Springs, Florida 34135 (the “Facility”), the undersigned adult (“Participant” or “Parent/Guardian”) agrees as
follows on behalf of themselves and the minor child(ren) listed below (“Minor Participant(s)”).

1. AUTHORITY TO SIGN FOR MINORS
I certify that I am the parent or legal guardian of the Minor Participant(s) listed below, or that I have been expressly
authorized in writing by the parent or legal guardian to execute this Agreement on their behalf. I accept full
responsibility for the supervision, conduct, and actions of the Minor Participant(s) at all times while at Big City Kids.

2. ASSUMPTION OF RISK
I acknowledge and understand that participation in activities at Big City Kids involves inherent risks, including but
not limited to slips, falls, collisions, equipment-related injuries, illness, permanent injury, paralysis, and death.
I knowingly and voluntarily assume all risks, both known and unknown, foreseeable and unforeseeable, for myself
and the Minor Participant(s), including risks arising from the negligence of Big City Kids or others, to the fullest
extent permitted by Florida law.

3. RELEASE AND WAIVER OF LIABILITY
I, for myself and on behalf of the Minor Participant(s), hereby release, waive, discharge, and covenant not to sue
Big City Kids, LLC, its members, managers, officers, employees, agents, affiliates, landlords, equipment
manufacturers, and insurers from any and all claims, demands, causes of action, or liabilities, including those
arising from the negligence of Big City Kids, resulting from participation in activities or use of the Facility, to the
fullest extent permitted by Florida law.

4. INDEMNIFICATION

I agree to indemnify, defend, and hold harmless Big City Kids from any claims, damages, losses, or expenses
(including attorneys’ fees) arising out of or related to my actions or the actions of the Minor Participant(s), except to
the extent prohibited by Florida law.

5. RULES, SAFETY, AND SUPERVISION
I agree to comply with all posted rules, verbal instructions, safety signage, and policies of Big City Kids. I understand
that failure to follow rules may result in removal from the Facility without refund.
I acknowledge that I am solely responsible for supervising the Minor Participant(s) at all times and ensuring
that activities are appropriate for their age and ability.

6. PROPERTY DAMAGE
I accept responsibility for any damage to the Facility or equipment caused by myself or the Minor Participant(s),
excluding normal wear and tear.

7. INFECTIOUS DISEASE ACKNOWLEDGMENT
I acknowledge that participation may expose me or the Minor Participant(s) to communicable diseases. I confirm that
neither I nor the Minor Participant(s) are knowingly ill or symptomatic at the time of entry and voluntarily assume this
risk.

8. PHOTO AND VIDEO CONSENT
I grant Big City Kids permission to use photographs or video recordings of myself and/or the Minor Participant(s) for
lawful purposes, including marketing, social media, and promotional materials, without compensation.

9. TERM OF AGREEMENT (IMPORTANT)
This Agreement is valid from the date signed through December 31 of the calendar year in which it is
executed.
A new Agreement must be signed for each calendar year in order to enter or participate in activities at Big City
Kids.

10. CHANGES TO ACTIVITIES AND FACILITY
I acknowledge that activities, equipment, layout, programs, and policies may change at any time during the term of
this Agreement.

11. GOVERNING LAW AND VENUE
This Agreement shall be governed by the laws of the State of Florida. Any legal action shall be brought exclusively
in the state or federal courts located in Lee County, Florida, and I consent to such jurisdiction.

12. SEVERABILITY AND ENTIRE AGREEMENT
If any provision of this Agreement is held unenforceable, the remaining provisions shall remain in full force and effect.
This Agreement constitutes the entire agreement between the parties.

I HAVE READ THIS AGREEMENT CAREFULLY AND UNDERSTAND THAT I AM WAIVING
LEGAL RIGHTS FOR MYSELF AND THE MINOR PARTICIPANT(S). I SIGN THIS
AGREEMENT FREELY AND VOLUNTARILY.
